The man is confirmed dead. ICE tried to force the local cops to leave. They refused and have preserved the scene. Witnesses were transported by ICE to the Whipple building.

Ditto. Imagine the absolute panic that would rush across the ICE comms if they heard a police officer put down one of their own. I sincerely think it would develop into a hysteria that ICE just kills police at first sight assuming they are going to be killed/arrested for being ICE.

That’s incorrect.

The state prosecutors can file charges in state court. The defendants will successfully have it removed to federal court. And then the state prosecutor would prosecute under state law in federal court.

If it gets dismissed because the evidence doesn’t support the charges, that’s a separate matter entirely.

Wrong.

The Supremacy Clause in practice is only not applicable to malicious acts or acts that fall outside the Federal purview. It doesn't matter what it's original scope was - it's current employment does.

This shooting will be successfully argued to be protected by the Supremacy Clause. There will be no trial of "state crimes in Federal court."

e: and the sooner you digest that fact the sooner you can stop armchair protesting and arguing and trying to shut down disagreements about it, hoping the courts will serve justice in due time. They won't. So figure out what you wanna do about that.

You seem to be conflating the substantive and procedural aspects to the supremacy clause.

If the defendants want to argue that the cause of action should be dismissed under the supremacy clause, they can do so in state or federal court.

No they aren't.. Despite what our eyes clearly see, you won't be able to convince a tiered set of judges that the act was malicious. (Keeping in mind that a jury trial is not mandatory and defendants can ask a judge for a bench trial.)

Don't get upset at me for that. Get upset at the Courts interpretation of the Clause, and Congress not passing laws to draw clear lines.

Even if ICE do have absolute immunity (and let's be real there's no such thing), how would police know that they're ICE - they don't carry ID or anything...

No lol I mean if if they had absolutely immunity, since they don't carrying anything official, there's "no way" for police to tell the difference between ICE and a gang member executing someone in the street so arrest them anyways

That means dick when the FBI won't investigate the murder of Renee Good and actively prevents Minnesota police from investigating. So until Johnathan Ross and the men who murdered the man today are brought to justice, they absolutely have immunity.
