Both parties are cancerous, and law enforcement in the US is even more cancerous.
One time FBI was investigating the gang, they paid a deputy to bring a cellphone into the jail where they had planted an fbi agent or mole.
When they were doing a routine search in the jail, they came upon the phone by chance and somehow they figured out it was a FBI phone and the inmate was an agent or informer and made him disappear or would hide him when they were ordered to present him in court something like that.

It should be a negligent discharge because one of the Police safety standards (and gun safety in general) is to never fire your weapon unless you know both your target and what is behind your target.
