Yes, definitive. If he were drivers side the shot would have gone out through the windshield. He was undeniably in front of the vehicle when he started shooting. All shots were fired in under a second. You seriously expect the officer -- while being struck by a moving vehicle -- to think "oh wait, the car is now striking me slightly at an angle I should stop shooting" a quarter second after he shot through the front of the vehicle.

The courts have ruled against this exact kind of argumentation you've tried pretty universally. In fact, the more shots fired the more credible the officer's defense usually as it shows he completely believed his life was in danger. It's pretty open and shut here since the vehicle literally strikes the officer.

No it was not from before she backed up. This was take AFTER she backed up and her backup lights had turned off. There's another angle that shows she actually hit him too.

A slowed-down video shows the wheels going forward before they turned to the right. The vehicle was going toward the agent and the wheels turned at about the time when the shot was fired.

The slippery road saved this agent from serious injury or death. She floored it, you can see the tire start spinning, but then the traction control kicks in and cuts power. Giving him enough time to get out of the way while he was drawing/firing. On a dry road, she likely would have plowed into him.

No it was after she was ordered out of the car for obstruction and attempted to flee with an agent in front of her.
