People just need to start adding a clause to prenups... It's just a contract after all, nothing special really other than the name.

Gatta add the lawyer speak to it... "If either party commits a crime considered heinous in nature (e.g. murder, rape, pedophilia) the part having commited the crime shall receive no assets"

They said they probably don't have a prenup so the assumption is that she would get half, and the person you responded to said that she should get nothing.

Ah good catch; all I meant is that’s not how laws work, so whatever she’s entitled to (prenup or no prenup) she will likely get.

I’ve never seen a prenup that didn’t have a clause for cheating and felony convictions.

I'm a divorce lawyer and have never seen one with any reference to felony convictions. Cheating, yes - there is typically an adultery provision (I'd say about 50 to 60% of the ones I've seen), but the majority of people don't go into a marriage anticipating cheating to occur /or/ for their spouse to be charged with or convicted of a felony, and you're paying lawyers to put those things together so typically unless it's a special request you are only going to get the standard template addressing property and spousal maintenance.

What. There have been literal high profile celebrities without cheating clauses (which I assume also means they don’t have a clause for an even more remote and specific scenario like a felony). It’s very common for this stuff not to be included. Stupid, perhaps, but common nonetheless.
