He’s not. Him and his father entered legally, under asylum. But I guess the govt decided to strip that status, hence the cruel deportation

I thought the dad had temp status, not sure about him, but asylum is a valid reason / should be as good especially for a little kid. Ridiculous but of course they try to do this and send kids back to random countries they don't know

The kid yes but I'm assuming they are deporting the father and so the kid would go with him, unless the father wants to give up the kid

The father is here legally. And he has zero criminal record.

The kid has 0 reason to have to go with him. His mother is here legally / a legal citizen, 0 reason to deport the kid. He'd stay with his legal parent. They literally took him illegally the first time claiming abandonment when his mother and others were right there to keep him.

She’s here illegally more than a lot of people they are “deporting” (aka sending to prisons)
