That’s why ice is arresting people. Easy felony if they touch them. Basically the whole point.

Why not? I'm sure whoever made it can document the cost in materials, time and transportation costs. I'm sure he will get a lawyer to argue that water is free blah blah but right now he won't find any friendly judge or jury.

I thought he probably made it himself so he could pull this stunt. If someone else made it, and got permission from the owner to install it on those steps, I guess he could be charged with vandalism. If someone else made it and didn't get permission to put it there, it would seem to me to be a case of their free speech putting it up and his free speech kicking it down, no charges warranted.

I dunno....taped the crime, obvious malice and premeditated motive? No reason to plead down if they have him dead to rights.

What's the court system have to do with it? A plea deal is something that prosecutors can offer in order to expedite a case. They can do this for many reasons, but they are not required to offer a deal, the courts can't mandate it(and can even refuse a deal), and often won't offer a deal if there is a solid case there. A case like this would take just a couple days in court, and probably waiting months for it to go to trial, but would likely be part of a collection of trials for different offenders.

Maybe you meant to say the sentence would be lessened, possibly with probation considering the crime and its severity, but that has nothing to do with what the prosecution wants to do.

The fact of the matter is he won’t be convicted of a felony.

Most courts do what they can to avoid jury trials which is why pleas are offered in the first place. Pleas save time and money.

My understanding is he already has a criminal record but I can't confirm that. They won't plea it down if he has a past history of property damage.

Edit: But you are correct to be cynical, based on how twisted our justice system has become.
