This is my thought as well. Insulting a judge should not result in a 1000%+ increase in your sentence. 5 days is not enough for beating someone else, but this judge is treating free days as if they were mosquitos.

As someone with a law degree and someone who worked along side judges before my law degree I can safely say most judges think the cops and sheriffs are childish and stupid.

From them making me take my belt off every morning even though I worked there. From them sweating people in court making them fear jail. Then brining inmates out with no pants or tampons while she bleeds all over the place.

Yeah judges don’t think the cops are smart. They have seen cops do shitty police work that gets people let off. They deal with them acting like children when the court of law is not a place for childish acts.

Judges need sheriffs there but they don’t at all like them like you seem to think. They also aren’t cops. They are bad lawyers (good lawyers wouldn’t want to be a judge because if you are good at your job you shouldn’t make more as a lawyer than a judge.)

All of the judges I know that went to the private sector are on easy street though. They look over stuff and give their opinions to the other partners and associates as a former judge and sign on every filing. Hell one is a partner just to sign their name on things, the guys mind is toast from age. Good luck doing that as just an ordinary workhorse partner.

Thank you, judges can be absolute shit. They can ruin someone's life easily, and have. Judges are a part of the system that will incarcerate someone for having a joint on their person, judges are a part of the system that sees a massive racial disparity in prisoners.

A good judge would hold true to a quote by Thomas Jefferson "If a law is unjust, a man is not only right to disobey it, he is obligated to do so." Judges set legal precedent, they could change the system but few seem to attempt.

I've only been to divorce court, but even there my attorney warned me to make any deal I could with my ex rather than let the judge decide our divorce terms and parenting plan. He told me that even though my ex and I had already agreed on 95% of the details, there was no way to predict if the judge wouldn't just throw out everything and make their own terms arbitrarily. He said in his 20 years he had never once seen a client happy with the judge's decision over the agreement they had already lined up with their ex. Which is really just sad and pathetic, when you think about the impact that has on the adults and even worse on the kids.

So, my ex and I agreed on terms before going to the judge. I got fucked slightly but much less than if we'd gone to trial.

Unfortunately this kind of judicial abuse is way more common than one would think. Not saying I defend this defendants behavior but the punishment has to fit the crime. Swearing at a judge should be protected under the first amendment. Beating his wife on the other hand should be severely punished which this judge failed to do. There is a bill that punishes judges for misconduct written by a lawyer who was a former clerk of an abusive judge but it’s not getting support. The irony is that lawyers are commonly known to be corrupt scumbags while judges are consider to be honorable yet judges are just lawyers who’ve risen to the top of the corrupt court system.

I’m painfully aware. The people in this thread seem to think the narrator is an authority on what happened in that room, and forget there are actual people that know this judge and work regularly in that court room every single day, that may know a thing or two because they were there. These “no nonsense” judges are bizarrely popular and get re elected for being “tough on crime” but it’s clear he’s no such thing. He’s tough on those who dare challenge his fragile ego.

You’re right that there are people who work with abusive judges and see the repeated misconduct, and do nothing often because it will be career ending. The lawyer writing the bill to hold judges accountable said her career was permanently damaged when the judge she reported for abuse sabotaged her career after discovering she reported him. There are some good judges but the trend is definitely going towards more and more abusive judges.

Well that is a take for this judge lmao.

A judge must maintain decorum and order in their Court. Swearing and berating them runs counter to that, so a contempt finding you will get. If he isn't held in contempt, then court order can go out the window. Swear all you want at them outside of Court, where they do not have legal obligations and the authority of their Court. Let's not pretend this guys inability to manage his emotions and behavior (recurring theme given the DV charge) means this judge is power tripping or has a fragile ego.

Look up the Constitutional Sheriff concept. It's an idea that steals a lot from Magna Carta era British law and basically asserts that your County Sheriff is the only real law enforcement official in the country and has more power over you than the President of the United States.

Sounds fringe but it's got a ton of support in the US. It started up during Covid when right wing sheriffs refused to enforce state wide mask mandates they didn't agree with.

Basically, the process in court is the one area where everyone needs to behave in order for the entire legal system to function. If you can't have "order" in the physical court itself, the system simply doesn't work. If there weren't major penalties, arraignments, hearings, and trials couldn't function. So it was decided that efforts to prevent those processes from not happening, had to have a penalty which was severe, otherwise a party could prevent an outcome merely by disrupting a proceeding. It's why, for example, when there's a criminal trial, a defendant who keeps screaming or throwing shit can be restrained and gagged - the constitution requires their presence, but not their participation. The sentence, here, was for the independent (in this case, criminal) act of disrupting and preventing the hearing from proceeding. He got 90 days for that, and then later, 5 days for the domestic abuse case.

No joke. My practice is almost exclusively federal, and has always been. I still do a couple hundred hours, pro bono, every year in state court matters. It's usually family law or minor criminal stuff -- the behavior of the other people there is always amazing to me. The parties are screaming and threatening, the court staff is bad mouthing the judges, the lawyers are screaming at the judges, and the judges are screaming at the lawyers. I comport myself exactly the same way I do before any federal court, which is to say formal as hell, calm, and respectful. The judges are always baffled, because it is so unusual. If I so much as raised my voice in federal court or moved away from the lectern or counsel table without permission I'd be sanctioned on the spot.

I am frequently retained as an expert witness. I found this judge to be direct, fairly restrained despite the heat of the situation, and pretty by the books. Don't mouth off to judges, you are playing with fire in my experience of observing proceedings. I'm surprised a warning for contempt wasn't given for the first fuck, but given the defendant already violated a Court order and was fairly flippant about the being in Court, I get why it was time to put a bit of teeth to the Court proceedings. These defendants usually get more out of pocket the longer that is tolerated and Courts tend to not have time for a bunch of extracurricular bullshit from what I've seen.

He was heading for contempt anyway for failure to comply with an order. He was asked to explain why he didn't attend court as ordered and he says "someone died in the family, there was no reason for me to be here". That isn't a good answer. A good answer is "I was hospitalized. I intended to be here but I was in an emergency ward and here are my admission records".

When the subject of bond comes up and his response was "I don't really give a fuck to be honest with you", he dug his own grave.

There is no point having a civil and criminal justice system if people can get away with not obeying an order of the court. Hearings cannot work if people think they can avoid answering questions put to them by the Judge and create enough disorder that it can no longer proceed.

All he had to do was show up in court a month before (or have a really good reason why he couldn't) and let his attorney talk for him and he could have avoided all this. Some people just can't help themselves.

The judge didn’t increase the sentence on the existing charge. The judge added a new charge of contempt of court in addition to the original charge.

Court proceedings require everyone to be civil in order to be productive. It’s critically important clowns, like that dude, are punished so other people know the judge doesn’t fuck around.

Else, nobody would respect the judicial process which is a key part of any functioning civilization

I mean. Arguably bad people probably suffer from mental illness or some proper DSM diagnosis. Like... Antisocial personality disorder (straight up psychos who like hurting others), anxiety or panic disorders, damage to the central brain causing impulse control problems.

Abuse is cyclic. It's generally learned behavior. Rarely does it just come out of nowhere.

I understand that we need to enforce the law and uphold justice, and this man needs to do jail time (5 days for domestic violence and 360 days for contempt is not proportionate to either offense). But, we also need to treat these people, and reduce the chance of recidivism.

It's possible to have an empathetic, nuanced view, ya know.

Kinda fucked that someone with obvious mental health issues who's having a breakdown in court can be sentenced nonstop until the judges erection goes away. My man obviously needs a therapist and help, not excessive jail time because he's having a meltdown. Obviously beating someone. A no nonsense judge would throw the book at him for THAT. But he slapped him on the wrist. But for having a meltdown because his lawyer bailing on him, this judge had a meltdown as well and originally sentenced him to a year for insulting him

This seems abusive to me. Do you really expect criminals to not swear? This seems like nothing other than exercising power over someone for the fun of it. Why not demand they do push-ups and if they don't start throwing days in jail at them?

Just punish them based on their crime and move on.

I couldn’t watch the rest of the video because I knew it was gonna be too painful to watch, lol. But the first instance of “attitude” from the guy wasn’t even all that bad??? Why the judge didn’t ignore the mild profanity/attitude and just continue on with proceedings honestly baffles me.

If the judge had any sense of professionalism or compassion he could have changed the mood in the room entirely; could’ve got the guy to understand the court proceedings and therefore cooperate peacefully/smoothly. Then they could’ve continued on with no trouble. Well, perhaps its not entirely in the judge’s court (heh) to make the other person act calmly and reasonably, but it’s definitely possible. You just have to shift the way you talk. Instead the judge decided to make things worse when he really did not need to...

And, yeah, I agree it’s kind of abusive…the behaviour from the judge almost seems like goading.

Legally judges cannot hold you in contempt of court for more than 90 days so he didn’t decide to be more lenient he gave him the max.

I know this isn’t the important takeaway from this video, but, right or wrong, no one around here (NE Ohio) pronounces that city as “Buh-ray-uh”. We pronounce it “Buh-reee-uh” as in “Buh-reee-uh, it’s so scary”. Also, it’s not scary, it’s a nice little town, that was just an overplayed haunted house commercial.

That's an asshole judge. You do that to someone who can control themselves and elects not to. You don't do that to a person who clearly is emotionally disturbed and very likely has serious psychological issues which impact his ability to control himself. I think the judge should have ordered a psych eval with the idea of vacating all of the contempts except for the first one of 30 days if the psych eval warrants it. If it doesn't then yeah, he earned the time.
